Prosecutor Used Flawed A.I. to Keep a Man in Jail, His Lawyers Say

The case of Kyle Kjoller, who was held without bail on gun possession charges, brought attention to the issue when his lawyers found that the prosecution's filings misquoted laws, misattributed court opinions, and cited non-existent legal precedents. These errors were found in at least four cases from the same prosecutor's office, raising concerns about a broader pattern of reliance on flawed artificial intelligence-generated content in legal documents.

The district attorney acknowledged the mistakes but claimed that artificial intelligence was only used in one of the briefs, not Kjoller's. Defense lawyers and a coalition of legal scholars have called for a state Supreme Court investigation, warning that unchecked use of artificial intelligence in legal filings could threaten due process and lead to wrongful convictions. The controversy highlights the growing risks of using generative artificial intelligence tools in the justice system, especially when prosecutors, whose arguments heavily influence judicial decisions, may submit inaccurate or fabricated legal information.

While the court denied a motion for sanctions against the prosecutor's office, it did order a new bail hearing for Kjoller. The district attorney's office has since implemented new policies and training regarding artificial intelligence use, but the case has sparked debate about the ethical responsibilities of legal professionals and the reliability of artificial intelligence in high-stakes legal proceedings.
