No court nod needed for sanction of 'debuttar' property bldg plan: HC | Kolkata News - The Times of India

The Calcutta High Court has ruled that shebaits, who manage temple properties dedicated to deities, do not need to obtain permission from a civil court to develop or alter private religious properties. The court directed the Kolkata Municipal Corporation to reconsider its demand for a court order before approving a building plan for property associated with Sree Sree Ishwar Janardhan Jew. Justice Gaurang Kanth clarified that shebaits are empowered to manage, develop, and utilize such properties as long as their actions are bona fide and comply with statutory requirements. The municipal authority's role is limited to ensuring adherence to building regulations and other statutory norms, not requiring court orders for property development.
