Michelle Walker, a real estate broker from St. Louis, has filed a federal lawsuit against Return to the Land, a whites-only housing development in the Ozark Mountains, alleging racial and religious discrimination. The community restricts membership to people who are white and heterosexual, and bars Jews, Black people and others without white European heritage. Walker says she was rejected after disclosing her Jewish ancestry and that her husband is Black.
Return to the Land has drawn national attention since announcing plans to build a network of whites-only compounds. Its founders argue that their structure as a private membership association allows them to legally limit who can buy shares tied to parcels of land. Legal scholars and civil rights advocates dispute that claim, saying federal fair housing and civil rights laws prohibit such discrimination.
Walker’s lawsuit cites violations of federal civil rights laws dating back to the nineteenth century and seeks damages as well as a court order to halt the group’s practices. The case marks the first civil legal challenge against the development, which has continued operating while a state investigation remains ongoing. The group’s co-founder said the lawsuit was anticipated and framed the dispute as a clash between freedom of association and civil rights protections.
